Scientifically speaking, because it is the ovary of the plant, it's considered a fruit. When it comes to taxes, the U.S. Supreme Court made the Nix v. Hedden (149 U.S. 304) decision which classified it as a vegetable. In cooking it's also considered a vegetable.

Or as elec said, "JUST EAT IT!"
